Official Contest Rules

ELIGIBILITY:
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. The Crank Brothers Quattro Road Pedal Contest IS OPEN ONLY TO UNITED STATES RESIDENTS 18 YEARS OF AGE OR OLDER AT TIME OF ENTRY. Employees of Crank Brothers or RoadbikeREVIEW.com (and the immediate family members of all such employees and all others with whom they are domiciled) are not eligible to win prizes. The Crank Brothers Quattro Road Pedal Contest is subject to all federal, state, and local laws and regulations. Void where prohibited.

HOW TO ENTER:
Enter by visiting www.RoadbikeREVIEW.com and following all instructions for completing the survey and entry form that appear in the Contest area. The Crank Brothers Quattro Road Pedal Contest will begin at 2:30 p.m. (PST) on Friday, June 25, 2004 and all entries must be received by 11:59 a.m. (PST) on Friday, July 30, 2004 (the "Contest Period"). You may enter the Contest once per person, five (5) grand prizes will be awarded. In the event of a dispute, all surveys and entry forms will be deemed to have been submitted by the owner of the e-mail account from which they were sent. Crank Brothers and RoadbikeREVIEW.com will not be responsible or liable for incomplete, late, lost, or misdirected entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, electronic malfunctioning of any network, hardware, or software. All surveys and entry forms become the property of Crank Brothers and RoadbikeREVIEW.com immediately upon submission. Email addresses will also be added to Crank Brothers and RoadbikeREVIEW.com's database for newsletter sign-ups and opt-in emails for receiving special email offers from our merchant partners. Your email will not be sold or rented to third-party merchants—this list will be maintained by RoadbikeREVIEW.com and Crank Brothers. You will receive no more than one message per week, and you can unsubscribe from the RoadbikeREVIEW newsletter or special offer mailings at any time.

HOW TO PLAY:
To participate, you must fully complete the user information section of the form. You do NOT have to answer all of the questions on the entry form, just give us your best entries. Submit your entries to Crank Brothers electronically by clicking on the Submit button. This will send the survey and entry form to Crank Brothers, in which case you will be eligible to win the prize described. Only entry forms with complete user information will be eligible to participate in the Contest.

PRIZES:
Five (5) Grand Prize winners will be selected based on creativity and humor among all eligible entries received during the Contest Period. The selections will be held on or about Monday , August 2, 2004. The Grand Prize winners will receive a pair of Crank Brothers Quattro Road Pedals. The winners are responsible for all other expenses associated with the acceptance or use of the prize.

ODDS:
The odds of winning a prize depend on the number of eligible entries received during the Contest Period and the number of eligible entries submitted by each contestant.

WINNING AND NOTIFICATION:
The winner will be notified by e-mail on or about Tuesday August 3, 2004 . Prize winners are solely responsible for the reporting and payment of any taxes on prizes. Any winner may waive his or her right to receive a prize, by any one of the following methods: (a) At the time the winner is notified by email, the winner may indicate that he or she intends to waive the prize, in which case the prize will not be delivered if the winner has delivered a signed, written waiver to Crank Brothers within ten (10) days after such notification; (b) At any time after notification but prior to delivery of the prize, the winner may waive the prize by delivering a signed, written waiver to Crank Brothers; or (c) After delivery of the prize, the winner may return the prize to Crank Brothers, along with a signed, written waiver, in which case the winner shall be responsible for all shipping costs in order to return the prize. No cash or other substitution is allowed. Rights to receive a prize are non-assignable and non-transferable. Submission of a survey and entry form constitutes the contestant's representation that he or she is eligible to participate. Except where prohibited, participation in the Contest also constitutes the winner's consent to the publication of his or her name and/or image on the Crank Brothers or RoadbikeREVIEW web pages, and to the inclusion of his or her name and/or image in any other related publications or web sites for any commercial or promotional purpose, without limitation or additional compensation.

RESTRICTIONS:
Prize is not transferable. Prize cannot be redeemed for cash value.
* Participation in the Contest constitutes an agreement by each contestant to comply with these Official Rules. Crank Brothers and RoadbikeREVIEW.com reserve the right to cancel or modify the Contest if it determines, in its sole discretion, that fraud or technical failures have destroyed the integrity of the Contest.
* By participating in the Contest, each contestant agrees that (a) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, by arbitration conducted in California according to the rules of the California Arbitration Act; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney's fees; and (c) under no circumstances will any contestant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
* All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the contestant and Crank Brothers in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law rules or provisions (whether of the State of California, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of California.

The Crank Brothers Quattro Road Pedal Contest is sponsored by Crank Brothers, whose decisions regarding the selection of the winner and all other aspects of the Contest shall be final and binding in all respects. Crank Brothers and RoadbikeREVIEW.com will not be responsible for typographical or other inadvertent errors in these Official Rules or in other Contest materials.
